These Terms & Conditions ("Terms") govern your access to and use of zenios.com (the "Site"), operated by The Zenios Group and its affiliated companies — 3 Pillar Homes, Evans Farm Land Development, Zenios Development, Zenios Construction, Zenios Properties, and Evans Farm Property Management (collectively, "Zenios," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates applicable law or regulation;
• Attempt to gain unauthorized access to any portion of the Site or its systems;
• Use any automated means (bots, scrapers, crawlers) to access or collect content from the Site without our written permission;
• Interfere with or disrupt the Site's operation or security;
• Upload or transmit viruses or other malicious code; or
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

2. Informational Purposes Only

The content on the Site — including descriptions of communities, homes, floor plans, lots, rental units, commercial spaces, pricing, availability, amenities, renderings, photographs, and project timelines — is provided for general informational purposes only. It does not constitute an offer to sell or lease, a binding commitment, or a representation or warranty of any kind. All information is subject to change without notice.

3. No Offer; Sales and Leases Governed by Separate Agreements

Nothing on the Site creates a contract between you and Zenios. Any purchase of a home or lot, or lease of a residential or commercial space, is governed solely by a separate written purchase agreement or lease executed by the parties. In the event of any conflict between the Site and a signed agreement, the signed agreement controls.

4. Renderings, Photographs, and Plans

Renderings, photographs, floor plans, site plans, elevations, and other images on the Site are artistic representations and may depict optional features, upgrades, landscaping, furnishings, or finishes that are not included in the base price or that may differ from what is actually built. Square footage, dimensions, and lot sizes are approximate. Zenios reserves the right to modify plans, specifications, materials, pricing, and community features at any time.

5. Pricing and Availability

Prices, incentives, interest rates, and availability shown on the Site are subject to change without notice and may not reflect current terms. Please contact us to confirm current pricing and availability before making any decision.

6. Intellectual Property

The Site and all of its content, including text, graphics, logos, photographs, renderings, floor plans, videos, and software, are owned by or licensed to Zenios and are protected by United States and international copyright, trademark, and other intellectual property laws. The ZENIOS name and logo, 3 PILLAR HOMES, EVANS FARM, and related marks are trademarks of Zenios or its affiliates. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any Site content without our prior written consent, except that you may view and print pages for your personal, non-commercial use.

7. User Submissions

If you submit information through forms on the Site, you represent that the information is accurate and that you have the right to provide it. You grant Zenios a non-exclusive, royalty-free license to use any feedback, suggestions, or testimonials you provide in connection with our business.

8. Third-Party Links and Services

The Site may contain links to third-party websites or services, including mortgage lenders, title companies, mapping services, and real estate portals. These links are provided for convenience only. Zenios does not endorse, control, or assume responsibility for the content, privacy practices, or availability of any third-party site.

9. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. ZENIOS DOES NOT WARRANT THAT THE SITE WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ZENIOS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR ANY CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL ZENIOS'S TOTAL LIABILITY ARISING FROM YOUR USE OF THE SITE EXCEED ONE HUNDRED DOLLARS ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless Zenios and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your use of the Site or your violation of these Terms.

12. Fair Housing

Zenios conducts its business in accordance with the federal Fair Housing Act, the Ohio Civil Rights Act, and all applicable local fair housing laws.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Delaware County, Ohio, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may revise these Terms at any time by posting an updated version on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

15. Severability; Entire Agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and Zenios regarding use of the Site.
